5.2.1 Applicable Leave Laws

Please find a brief description below of the state and federal laws that can apply to leaves of absence. Following the descriptions you can find the related SPU leave programs/policies related to FMLA and other applicable leave laws.

Family and Medical Leave Act (FMLA)

A federal law that provides eligible employees with up to 12 weeks of unpaid, job-protected leave in a 12-month period for certain family and health-related situations. These include personal medical conditions, caring for a seriously ill family member, bonding with a new child, or specific military family needs. Health benefits continue during FMLA leave. Washington Paid Family & Medical Leave (PFML)

A Washington State program that offers partial wage replacement when you need time off to care for your own serious health condition, a family member’s health needs, or to bond with a new child. Benefits are paid through the state, and eligible employees can receive up to 4–18 weeks of paid leave, depending on circumstances. See this link for an expanded explanation of PFML.

Washington Family Care Act (FCA)

This state law allows you to use your existing accrued paid sick or vacation leave to care for a family member with a serious health condition or your child with a routine illness or medical need. It gives you flexibility to use the paid time you’ve earned when your loved ones need support.

Washington Military Family Leave Act (MFLA)

Under this state law, if your spouse is in the military, you may take up to 15 days of unpaid leave when they are deployed or on leave from deployment. You may use your own accrued vacation leave to cover this time off. MFLA can be used alongside FMLA, if both apply.
